Clicks-on, Inc. DBA ClicksOn.com Terms and Contract for Domain Sales By purchasing a domain name, you accept that "I(you) Agree to Terms and Conditions".
Domain Terms of Purchase
1. Payment
1.1 The Purchaser and/or buyer, will pay the Purchase Price to
ClicksOn.com by the following methods:
(A) Payment by Credit Card or with PayPal for domain prices equal to or less than $1600.
(B) Payment via ESCROW.com for purchase prices exceeding $1600.
- Should Purchaser and/or buyer choose to use ESCROW.com for the purchase of domain(s) exceeding $1600., Purchaser and/or Buyer agrees to pay 1/2 half of all fees associated with the use of service provided by ESCROW.com
- Payment must be received through Escrow.com within 6 hours from the time that payment instructions are sent to the Purchaser. If payment is not received within 6 hours, the domain name (at our option) may be committed to the next prospective Purchaser.
2. Refunds
2.1 All purchased domain name(s) are considered a final sale at the time of purchase. Purchaser and/or Buyer is considered the owner of any domain name(s) purchased through ClicksOn.com once full payment is verified, completed, and domain transferred. The purchase price(s) for any and all domain name(s) including any and all fees associated with the transfer are non-refundable.
3. Transfer Of Domain Name(s)
3.1 Upon receipt and verification of the Purchase Price for the domain(s), ClicksOn.com agrees to immediately transfer complete ownership of the Purchased Domain Name(s) to the Purchaser and/or Buyer into the Purchaser and/or Buyers account at domain(s) current registrar.
3.2 The Purchaser and/or Buyer agrees to allow ClicksOn.com to transfer ownership of domain(s) to purchaser and/or buyers account at domain(s) current registrar.
3.3 The Purchased Domain Name(s) will be transferred to the Purchaser and/or Buyer by pushing the Purchased Domain(s) into the Purchasers and/or Buyers account at the registrar where the domain(s) are registered. No Transfers will be made to a differant registrar.
3.4 The Purchaser and/or Buyer must open, allow ClicksOn.com to open, or have previously opened an account with the designated registrar. Transfer will not be completed until the required account(s) have been opened. The domain(s) will not be transferred to another registrar by ClicksOn.com
If the Purchaser and/or Buyer wants to transfer the domain(s) to another registrar besides the registrar that the domain(s) currently is registered with, the purchaser and/or Buyer may do so after they obtain full legal ownership of the domain(s), subject to any terms of the registrar.
4. Warranty & Disclaimer
4.1 The Purchaser and/or Buyer agrees that the use of this website and the facilities provided herein ("the Website"), shall be at their sole risk and that the Website is provided on an "as is" and an "as available" basis.
4.2 To the full extent permitted by law, ClicksOn.com disclaims all warranties of any kind relating to the Website (ClicksOn.com) and the Purchased Domain(s), whether express or implied, including, but not limited to, any implied warranty of merchantability, brandibility, and performance for any particular purpose.
4.3 All the domains offered for sale by ClicksOn.com are intended to be highly generic in nature. None are known to be subject to trademark or intellectual property claims in any jurisdiction in the world. Nevertheless, ClicksOn.com takes no responsibility for any future trademark or intellectual property claim which may occur in respect of any of the domains offered. It is the customer's sole responsibility to ensure that any domain they purchase is not the subject of a trademark or intellectual property claim in the jurisdiction(s) in which they operate, and any such purchase and use of a domain name from ClicksOn.com is done solely at the buyer's own risk. ClicksOn.com makes no warranty that any domain name offered for sale does not violate or conflict with the prior rights of any third parties with regards to any business name, trademark or any other common rights or intellectual property rights. ClicksOn.com makes the important statement that no examination has been made with regard to finding or identifying any such pre-existing rights. It is the sole responsibility of the buyer to initiate a search for any such rights prior to purchasing a domain name or names from ClicksOn.com. ClicksOn.com makes no warranty that the buyer may use any domain or domains after purchase from its website without violation of the rights of any third party. It is the sole responsibility of the buyer to ensure that a domain may be used without infringing any such rights by performing a comprehensive search and investigation.
4.4 The Purchaser agrees to release, indemnify and forever hold harmless, ClicksOn.com and its agents, officers, directors and employees, from any and all claims, demands and damages (actual or consequential) of every kind and nature, disclosed or undisclosed, arising out of or in connection with entering into the Domain Sale Agreement, the Purchased Domain(s) and/or the use of the Website.
4.5 Nothing else if provided with a Domain Name. A purchaser receives full control of the Domain Name only. There is no hosting or website provided with said Domain Name. Clicks-On, Inc. sometimes has a promotion such as a website optimization guide. If this is advertised, the purchaser will receive such a guide. However, such a guide is provided as-is with no representation of quality, effectiveness, or warranty.
5. Other
5.1 Advertised Domains are available on a first-come, first-serve basis. Once the Purchaser initiates the Domain purchase process, domain availability is then considered "Purchase Pending". During this stage, purchase requests by others are denied. The "Purchase Pending" status changed to "Sold" once payment is received AND the domain is transferred into full control of the Purchaser. Purchaser has a limited time in which payment must be submitted, as described in Section 1.
